The National Mobility Equipment Dealer’s Association and its Logos, including: the acronym NMEDA, the NMEDA Seal and the QAP logo, are registered trademarks under the United States Lahnam Act and Canadian Trade-marks Act in Canada (Canadian applications pending) and are the protected intellectual property of NMEDA in both the United States and Canada.

As registered marks of NMEDA, NMEDA exclusively owns the rights to the use and display of the marks throughout the countries.  NMEDA does allow limited, nonexclusive licenses to use its marks according to the following policy:

NMEDA members in good standing may use and display the NMEDA member logo. “Good standing” includes only those members that are current in the payment of their membership dues and assessments and adhere to all NMEDA Guidelines and policies.

Members in good standing are authorized to use the NMEDA logo for the purpose of identifying their membership in NMEDA. The NMEDA member logo may not be used in any manner to imply that a member is in any way an agent of NMEDA or that NMEDA in any way warrants, approves, or endorses any product or service provided by the member.

Members who incorrectly display the logo, or misrepresent its meaning, shall indemnify and hold NMEDA harmless from any and all claims or liabilities resulting from such misrepresentation.

Mobility Dealer members who have qualified for the NMEDA Quality Assurance Program, and who remain in “good standing” under the QAP program, are licensed to use the QAP Logo.

QAP members in good standing are authorized to use the QAP logo for the purpose of identifying their QAP status in NMEDA. The QAP logo may not be used in any manner to imply that a member is in any way an agent of NMEDA or that NMEDA in any way warrants, approves, or endorses any product or service provided by the member.

Members who incorrectly display the QAP logo, or misrepresent its meaning, shall indemnify and hold NMEDA harmless from any and all claims or liabilities resulting from such misrepresentation. They are also subject to disciplinary action under the QAP program up to, and including, decertification under the QAP program.

The NMEDA marks identified above can be displayed by qualifying members on their business cards, letterhead, shop window, and promotional materials. Any other use of the NMEDA logos not specifically enumerated must be approved by NMEDA.

Individual members (i.e. Associate Members) are prohibited from allowing their employer to use the NMEDA logo. Any employer who does so will be subject to trademark infringement liability.

The NMEDA marks are non-transferable.  They may not be used by subsidiary businesses (even if wholly owned and controlled).

The NMEDA member logo should be printed using the following colors: black, blue (PMS 301) on a light background, or white on a colored background.

The right to use the NMEDA marks as identified above shall terminate and be revoked upon the member’s failure to remain in good standing, in the event of misuse by the member as determined by NMEDA, or any other breach of this Policy for Use. Upon such termination and/or revocation, the member will immediately cease all use of the NMEDA marks and delete the marks from all materials, products, and services, regardless of whether such materials, products, and services are preprinted or pre-existing at that time.

Legal action will be taken against anyone who uses the NMEDA member logo in violation of the above policy.
